A marriage conducted while a lady is in her menses is valid according to a brief explanation of Dr. Ahmad As-Suwei` Shleibak on this matter. The Dr. says:
‘The Nikah is valid and correct but the man can not have sexual intercourse with his wife (while she is in her menses), as that is categorically forbidden by Allah. However, the man is allowed to do everything with such a wife except intercourse or penetration’
