Sheikh `Abdul-Majeed Subh, a prominent Azharite scholar, states: “The basic ruling is that the mahr is a woman’s right. However, if a woman is seeking divorce, the case may be different. So, the question is: what is the reason for seeking divorce? If it is for a hidden fault the husband hid from his wife before marriage, then a wife has the right to your whole mahr. But if the wife is seeking divorce for another reason from her part and it is not from the husband part, then she has to give him back what they agree on whether the whole mahr or less than the mahr or more than the mahr.”
