The prominent Muslim scholar, Sheikh Muhammad Iqbal Nadvi, Director and Imam of Al-Falah Islamic Center, Oakville, Ontario, Canada, states: “There are two different situations here. According to Shari’ah, children belong to the better of the parents in terms of deen and manners. It means when the wife is Muslim and the father is not, they belong to the mother. If the father is not a Muslim, the children are to be given to the mother’s custody.”
