Inheritance Rules

My Mother (Rahmatullah Alayha) passed away early this year . She left a house ,The DEED is in her Name . She left five sons & three daughters as Heirs .However ,Originally , the House was bought 28 years ago by four of her sons and the House DEED was issued in our Mother's Name .The Official HASR EL ERTH list the eight childern as HEIRS .My Question is : Should the funds of the sale of the house be distributed  a) among the Eight Childern as per HASR EL ERTH or b) Among the four Sons who actually bought the house for mother . P.S. Our Father passed away 45 years ago and the 4 sons were taking care of the family expenses until our mother's death .

Dear scholars, As-Salamu `alaykum. A couple died in a plane crash but nobody knows who died first. The husband has another wife and children still living, and the wife has two cousins. How should the estate be divided? Jazakum Allah khayran.

Dear scholars, As-Salamu `alaykum. My wife and I suffered a lot so that we might get a child, but Almighty Allah did not will it. I now want to transfer the ownership of my apartment to my wife so that she won’t be treated unfairly by my brothers after my death when it comes to distributing the possessions I leave behind. Dear scholars, As-salamu `alaykum. If my father is still alive after my mother’s death does he become the natural owner of everything my mother owned, or is there an Islamic injunction that my mother’s assets should be distributed?If there is to be a distribution what are the shares? My family now consists of my father, my four sisters and myself. I was of the opinion that as long as my father is alive I do not have to bother about any distribution. Please advise.I would also like to know about zakah. Where did the 2.5 percent figure come from? In the hadith it is mentioned that zakah must be paid on silver at this rate, but does that apply to everything? Does the Qur’an mention anything about that? Jazakum Allah khayran.

Dear scholars, as-Salamu `alaykum. I have a question that always confuses my mind. I hope you could explain it to me. Why does a man take a portion equivalent to that of two females in inheritance? Is it a form of discrimination based on gender? Jazakum Allah khayran.

Dear scholars, As-Salamu `alaykum. If you adopted a child, is it permissible to give a part of your wealth to him/her in your will? Jazakum Allah khayran.

As-Salam `alaykum, Waramatullah Wabarakatuh! If a Muslim man marries a non-Muslim, say someone from the People of the Book, and it happen that the lady is of good manners, giving her husband affectionate and tender-loving care, is it permissible to make such woman one of the husband’s heirs; to inherit him when he dies? Is such husband allowed to allocate some of his property to his wife, according to Islamic Law? Is he allowed to bequeath or donate some money to her? If so, what is the limit he is not allowed to go beyond in both cases?

Respected scholars,  as-salamu `alaykum.a man has a mentally retarded son and three daughters. This man appropriated one third of his estate to his son after his death, and he did so while he was still alive. What is the ruling on what this man did? Jazakum Allahu Khayran.

What is the wisdom of the discrimination in the distribution of inheritance between men and women in Islam? Is it because of the natural differences between them?

Dear scholars, As-Salamu `alaykum. If a man concluded a marriage contract and died before the consummation of the marriage, what is the wife’s due dowry in this case, and does she inherit from him or not? Jazakum Allah khayran.

Respected scholars of Islam, As-Salaam `Alaykum wa Rahmatu Allah wa Barakatuh. What is the situation of Muslims living in Western countries with non-Muslim parents (i.e., mainly converts) regarding the question of inheritance.Are the properties transferred to them according to the Western laws at the death of their parents Halal (lawful) for them or not?
