Speaking during sexual intercourse is permissible as there is no evidence indicating otherwise. As for speaking in the toilet, it is reprehensible and undesirable according to some fiqh schools as there are some reports indicating this reprehensibility. However, there is difference of opinions concerning these reports. So, it is better to avoid it, but it is not haram to do it.
