There is deception in selling fish that are in water because it is built upon obscurity, and agreements that are based on obscurity are not allowed in Islamic law, except in agreements about donations. Since selling fish in the water is not a donation, it is a transaction, therefore, this agreement is incorrect and not allowed according to Islamic Law.
