The eminent Muslim scholar and renowned Da`iyah, Sheikh `Abdel Khaliq Hasan Ash-Shareef, states: “The application of Shari`ah is not only confined to the application of hudud or punishments, rather it is the application of the teachings of Islam in all aspects of life including the prevention of illicit privacy and haram mixing between people of the opposite sex and the willingly commitment of women to hijab and chastity, etc. Blaming a raped woman for not taking precautions does not in any way justify the crime done against her which is punishable in Islam and the man-made laws.

Actually, it should be clear that the crime of rape can be proven by many ways such as the witnesses, the confession of the accused, the scientific methods, etc. While investigating this crime, no evidence can be skipped. The crime may include kidnapping, forcing, tearing the woman’s clothes, etc. Actually, there are many ways to prove the crime.

Also, it should be clear that rape issue has too many cases and each case is judged accordingly and there is no one ruling for all cases as virtually there may be a case of an evil woman who is proven to claim that she has been raped by a certain person who is proven innocent of that. There may be another case of woman who is really raped but may not be able to prove the accusation against a person due to any reason. In this case, she is not supposed to be punished.
