Talaq Al-Kinaya
As-salaam o alaykum wa rahmat Allah, I am under a lot of stress and anxiety and need your immediate help. I need to ask, will a divorce happen when a person did not even know that what he said can imply divorce? I am concern about Talaaq-E-Keenaya. I said to my wife's father once when I had a fight with my wife that "please take your daugther with you". At the time of making that statement I had NO KNOWLEDGE that this can imply divorce. I definitely was considering divorce in my mind and was thinking that I will divorce her soon. But, as I said, my knowledge was that I have to pronounce divorce clearly so in my mind I was only thinking about divorcing her ( when the statement was made) and did not divorce her yet consciously and knowingly. Is this situation counted as divorce? Are mistakes like this due to ignorance counted against us? This is also not common knowledge that divorce can happen by implied statements too. I truely did not know that divorce can happen without using the words of divorce in clear and explicit terms. I am suffering from anxiety due to this and confused what to do. This event happened 3 years ago and its causing me mental problems as I have recently read about Talaaq-E-Keenaya. I have read that a muslim is not accountable if he does something by mistake or due to lack of knowledge:these are some verses that are refered in answers on your website: Our Lord! Punish us not if we forget or fall into error) (2:286). “And there is no sin on you concerning that in which you made a mistake, except in regard to what your hearts deliberately intend” [al-Ahzaab 33:5] Please help me with this situation.Jazzak Allah.
