Is it allowed for a Muslim to behave and live as a non-Muslim, if he works as a spy in favor of Islam, keeping in mind that such a person may not perform prayers?

Dear Shaikh, I have two questions and would appreciate if you can answer both of them,1. Is it permissible for a muslim country to use espionage to get weapons technologies from the disbelievers, for example, as it is well known that Pakistan has used espionage against western countries through its intelligence to get nuclear secrets and missile related technologies?2. Can you please tell me how is booty collected in in Islam?Is it taken from the civilians also which are conquered? I know one-fifth is for Allah and his messenger, but does the Amir(ruler) also get a share from it?

Dear scholars, As-Salamu `alaykum. I have a question about the death penalty in Islam. I know that in the case of murder the murderer has to be executed unless he gets the `afw (forgiveness from the family of the deceased). What does Islam say about the punishment for spying for another country? Jazakum Allah khayran.
