custody

I am a revert to Islam of 10 years and I have a 12 year old daughter of a previous marriage.  I am now remarried to a muslim man.  My ex husband states that according to islamic law my daughter should go to live with him now that she has attained puberty.  He is not a muslim but has assured me that her declaration of being muslim will be respected.  What is the ruling on a case of a muslim and non muslim in custody when the mother is the believer?  Your immediate response is appreciated.I just want to add that my daughter has said that she is not against living with her father as she thinks it is a good opportunity to make dawah and to get to know her paternal relatives and father better.  Her father lives in the US and we live abroad.

I have recently been irrevecably divorced by my husband after a separation period of 1year.  I have a child to support and I have a part-time job.  I wanted to know what the ruling would be with regards to iddah according to the Shariah because my situation is such that I have to go out to earn my living. Also I would like to clarify the issue of child custody following a divorce.  Jazak'Allah khair.

what happen to the children qhen a couple divorce? Who should they stay with? Can you aply the law of the country where you live?

As-Salamu `alaykum! My wife seeks divorce for the mere reason of being no more interested in our marital life. Now, the question is: To whom the custody of children goes after divorce, bearing in mind that we have three children under five. As far as I know, the mother has the right to keep the children in her custody until they reach puberty, then they should be moved to their father. If I refused to divorce my wife, she will seek divorce through courts. Am I allowed in this particular case to claim the custody of children?

As-Salamu `alaykum! If a widow wishes to remarry and the man she wishes to marry agrees and wants to take care of her children and the children want to live with their mother and new husband, can the family of the children's father still take the children away from their mother (the children are 13, 11 and 7)? Is not the threat to take away a woman's children not hindering her from marrying? I am an American Muslimah living in the Middle East. My late husband was an Arab Muslim. I have no family support where I am but do not wish to move back to the US as my own family are still not Muslims and I want to raise my children in an Islamic environment even though it means some difficulty for myself. Please answer my questions as I am in a terrible situation and don't know what to do. Thank you!
